These Terms of Service ("Terms") are issued by Porchlight Labs LLC ("we," "our," or "us"), a Limited Liability Company incorporated in the State of Wyoming, United States. By using MowPlan (the "Service"), you agree to these Terms.
Eligibility and Accounts
You must be at least 18 years old to use MowPlan. You are responsible for maintaining the security of your account and for all activity that occurs under your account. Sharing login credentials without authorization is prohibited.
Subscriptions and Payments
MowPlan is provided on a subscription basis. Payments are processed securely by Stripe. We do not store your payment information. Subscriptions renew automatically unless canceled. Refunds are not provided except as described in the Service Availability section below.
Use of the Service
You agree not to misuse MowPlan. Misuse includes, but is not limited to: attempting unauthorized access, interfering with servers or networks, reverse-engineering, or using the Service for unlawful purposes.
Intellectual Property
All intellectual property rights in MowPlan, including code, branding, and design, are owned by Porchlight Labs LLC. You retain ownership of your data but grant us a limited license to use it as necessary to operate and improve the Service.
Service Availability (SLA)
We aim to provide MowPlan with 99% uptime each calendar month, excluding scheduled maintenance and factors outside our reasonable control. If MowPlan experiences an unplanned outage exceeding 24 consecutive hours, you may request a credit equal to one month of your subscription fee.
To receive a credit, you must submit a request to support@mowplan.com within 30 days of the outage. This SLA does not apply to interruptions caused by your internet connection, third-party equipment, scheduled maintenance, or force majeure events.
Termination
We may suspend or terminate your account if you violate these Terms. You may delete your account at any time, and your associated data will be deleted in accordance with our Privacy Policy.
Disclaimer of Warranties
MowPlan is provided 'as is' and 'as available' without warranties of any kind, whether express or implied. We do not guarantee uninterrupted or error-free operation.
Limitation of Liability
To the maximum extent permitted by law, Porchlight Labs LLC is not liable for any indirect, incidental, or consequential damages, including loss of profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid in subscription fees in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Porchlight Labs LLC from and against any claims, liabilities, damages, and expenses arising from your misuse of MowPlan or violation of these Terms.
Changes to Terms
We may update these Terms from time to time. Updates will be posted on this page with a revised 'Last Updated' date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
Governing Law
These Terms are governed by the laws of the State of Wyoming, United States. Any disputes arising under these Terms will be resolved in the courts of Wyoming, unless otherwise required by applicable law.
